Abstract

Regulations regarding rehabilitation and criminal dismissal for TNI personnel who commit narcotics abuse still have various problems in Indonesia. This is because there are no clear rules regarding special rehabilitation for the TNI and regulations regarding the dismissal of members of state institutions for abusing narcotics. Therefore, this study intends to find out the ideal rehabilitation rules for the TNI who abuse narcotics and the application of additional penalties for dismissal for the TNI who abuse narcotics. This research methodology uses normative juridical. The results of this study are 1) There needs to be a difference in the way of handling rehabilitation between civilians and TNI soldiers who abuse narcotics because TNI soldiers have special abilities that are not owned by the community in general so that the way of rehabilitation must be different to make it more fair, 2) Application of additional punishment in the form of The dismissal of TNI personnel who commit narcotics abuse is permitted and regulated by the Military Criminal Code where the additional punishment is a special authority given to judges when examining cases in Military Courts.
